PARTICIPANT INFORMATION

ASSUMPTION OF RISK

I acknowledge that participation in Ninja Elimination Series (NES), LLC competitions involves inherent and significant risks including, but not limited to:

  • Falls from obstacles
  • Equipment or rigging failure
  • Structural movement
  • Grip failure or rotation
  • Collision with athletes or structures
  • Fatigue from repeat runs
  • Physical exhaustion
  • Head injury, paralysis, or death

RELEASE OF LIABILITY & INDEMNIFICATION

Participant agrees to indemnify, defend, and hold harmless:

Ninja Elimination Series, LLC ("NES"), its owners, officers, directors, members, managers, employees, contractors, volunteers, agents, representatives, sponsors, partners, host facilities, venue operators, event staff, and affiliated organizations...
...and any and all other persons or entities acting in any capacity on behalf of NES.

...from any and all claims, demands, actions, causes of action, damages, losses, costs, expenses (including reasonable attorney fees), and liabilities of every kind and nature, whether known or unknown, arising out of or in connection with Participant's participation in any NES event, including but not limited to claims for personal injury, death, property damage, or any breach of this waiver.

This release is governed by the laws of the State of Arizona and applies to the fullest extent permitted by law, excluding gross negligence or willful misconduct.
